Zhai & Associates recently secured a significant outcome for a client facing a serious drug manufacture allegation in the Parramatta District Court. Our client was originally charged with Large Commercial Manufacture of Methylamphetamine following an investigation into a drug laboratory in Fairfield Heights, where police located approximately 11 kilograms of methylamphetamine after an explosion at the premises. CCTV footage captured our client at the location on the day in question, and he was subsequently arrested and charged.
Following negotiations with the prosecution, we successfully secured a substantial reduction in the charge. The prosecution accepted a plea to Knowingly Taking Part in the Commercial Manufacture of Methylamphetamine after it was acknowledged that there was no evidence establishing what our client had actually done while present at the premises. The agreed facts confirmed that our client was only present for a limited period and was not observed carrying anything into or out of the drug laboratory.
During sentence proceedings, we relied on evidence regarding our client’s personal circumstances, long-standing struggles with drug addiction, rehabilitation efforts, family support, and genuine remorse. We also highlighted the limited nature of his involvement and the absence of evidence demonstrating any active role in the manufacture process itself.
His Honour accepted that the plea of guilty was meaningful, acknowledged our client’s rehabilitation prospects and remorse, and took into account the progress he had made while in custody. The Court ultimately imposed an 18-month fixed term of imprisonment commencing from the date of arrest, making our client immediately eligible to reapply for parole.
This outcome demonstrates the importance of strategic negotiations, careful analysis of the prosecution case, and thorough sentence preparation in achieving the best possible result in serious criminal matters.
