NO JAIL FOR YOUNG DRUG RUNNER

Sometimes drug dealers can be young vulnerable people who make mistakes but giving them the opportunity and support to turn their life around can ensure they do not reoffend, benefiting the community in the long run.

After an investigation into an incident involving an improvised explosive device, police discovered a group of young men who were supplying drugs out of an apartment in Zetland using the social media app Snapchat . Police began tapping the mobile phones of the syndicate members and bugging the ‘drug house’ with surveillance devices.

The client was captured on surveillance devices accessing, preparing and packaging prohibited drugs on a daily basis for 2 weeks. When police raided the property, they found significant street-level quantities of MDMA, Cocaine, Cannabis and LSD. The client was charged with possessing the drugs for the purpose of supply, possessing drug manufacturing equipment and participating in a criminal group.

The client was an 18-year-old man with no prior criminal history, severe mental health issues and drug addiction.

After extensive negotiations, the prosecution agreed to drop the supply charges relating to the drugs and equipment found in the apartment as we were able to demonstrate that although he was able to access the drugs to package and sell them, he could not do so without authority from his superiors and therefore did not legally have ‘possession’ of the drugs.

After successfully securing his release on bail in the Supreme Court, the client engaged in drug rehabilitation began working and studying as well as rekindled his relationship with his parents. Addressing these issues (which had led the client to become a ‘runner’ for the group in the first place) gave the court confidence that he would not re-offend.

As a result of the negotiations and the significant rehabilitation undertaken by Mr Nguyen, he was given a Community Corrections Order for 12 months with a condition to be of good behaviour for that period, abstain from drugs and continue counselling.
